Comments Sought on Marital Law

A discussion paper identifying issues to be considered in the proposed reform of the Matrimonial Causes Law is now submitted by the Law Reform Commission.

The paper sets out questions for consideration by the public and contains no final recommendations on any matter by the Commission.

The Commission invites comments on a variety of matrimonial issues including those relating to:

  • damages for adultery
  • compulsory mediation or counselling in divorce proceedings
  • statutory recognition of pre-nuptial agreements, and
  • whether the law should be reformed to provide for one ground for divorce i.e. irretrievable breakdown.

The Commission also invites suggestions for other areas of reform of the Matrimonial Causes Law. The discussion paper can be accessed on the home page under Features.
