Terms of Reference
This matter was referred to the Commission in 2007 by the Attorney General pursuant to the request of the Society of Trust and Estate Practitioners which was of the view that legislation was needed to introduce and regulate enduring powers of attorney. The review was carried out from 2007 to 2009 and the Commission recommended against the introduction of such legislation for a variety of reasons including the fact that there was no body in the Islands to oversee the regulation of such powers of attorney.
Outcomes
The recommendation of the Commission was accepted.
